2) Eligibility and Account Responsibilities

4) Assessments and Results (No Individual Performance Evaluation)

FRWS may offer leadership/wellness assessments. By using an assessment, you understand and agree:

• assessments are intended to provide informational insights and education

• results may be generated via automated workflows (including formulas/scripts)

• assessments are not a diagnostic tool and do not evaluate any individual’s clinical condition or individual job performance

You are responsible for how you interpret and apply assessment outputs.

5) Payments, Billing, and Renewals

A. Payment Processing

Payments may be processed through third-party payment processors, including Stripe and PayPal. We do not store full payment credentials on our servers.

B. Subscriptions and Auto-Renewal

If you purchase a subscription membership, your membership may renew automatically until you cancel, according to the plan terms shown at checkout.

C. Taxes

You are responsible for any taxes that may apply to your purchase unless otherwise stated.

6) Cancellation and Refund Policy

A. Canceling a Subscription

You may cancel a recurring subscription at any time through your account dashboard (if available) or by contacting us at [email protected]. Cancellation stops future renewals; it does not retroactively refund past charges unless required by law or explicitly stated.

B. Refunds

Unless a specific written refund policy is presented at checkout for a particular product, purchase, or membership:

• Digital products and immediate-access memberships are generally non-refundable once access is granted.

• We may, at our discretion, provide refunds or credits in unusual circumstances (e.g., duplicate charges).

If you submit content (e.g., testimonials, comments, feedback, questions), you grant FRWS a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content for operating and promoting the Services, unless you explicitly request otherwise in writing.

Do not submit confidential, sensitive, or proprietary information you do not have the right to share.

By using the Services, you consent to receive transactional emails (e.g., receipts, password resets, membership updates, assessment results). If you opt into marketing emails, we may send additional communications; you can unsubscribe from marketing at any time.

FRWS does not provide medical advice, mental health diagnosis, legal advice, or clinical services through the Site. Content is educational and informational. You should consult qualified professionals as appropriate.

FRWS makes no guarantees that:

• assessments will identify all organizational risks or needs

• the Services will be uninterrupted, error-free, or completely secure

12) Limitation of Liability

To the fullest extent permitted by law, FRWS will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or business interruption arising from or related to your use of the Services.

In any event, FRWS’s total liability for claims related to the Services will not exceed the amount you paid to FRWS for the Services in the three (3) months preceding the event giving rise to the claim (or $100, whichever is greater), unless applicable law requires otherwise.

13) Indemnification

You agree to indemnify and hold harmless FRWS and its officers, directors, employees, contractors, and agents from any claims, liabilities, damages, and expenses (including reasonable attorney’s fees) arising from:

• your misuse of the Services

• your violation of these Terms

• your violation of any rights of another party

14) Termination

We may suspend or terminate your access to the Services at any time if we believe you have violated these Terms or if required for security, legal, or operational reasons.

Upon termination, your right to access the Services ends immediately. Sections that by their nature should survive termination (e.g., intellectual property, disclaimers, limitation of liability) will survive.
